1. Introduction

Welcome to New Generation Taekwondo Club (NGTC). These Terms of Service ("Terms") govern your access to and use of our website at newgentkd.com and your participation in any services, classes, programmes, memberships, trials, or activities provided by NGTC.

By accessing our website, booking a class, making payment, attending a session, or allowing a child to participate, you agree to be legally bound by these Terms in full.

If you do not agree, you must not use our website or services.

2. Services Provided

NGTC offers the following services, including but not limited to:

Group Taekwondo Classes – regular weekly classes for children, teens, and adults
After-School & School-Based Programmes – delivered at partner schools, including Sacred Heart Roehampton
1-to-1 Private Sessions – personalised training sessions
Trial Classes – introductory sessions for new students

NGTC reserves the right to modify, suspend, relocate, replace instructors, reschedule, or discontinue any service at any time. Where reasonably possible, notice will be provided. No refunds or compensation are payable for such changes.

3. Eligibility & Registration

Minors (Under 18)

Participation requires parental or legal guardian consent
A parent/guardian must complete registration and accept these Terms on the child's behalf
The parent/guardian confirms they have full legal authority to do so and accepts responsibility for the minor's participation

Accurate Information

You must provide accurate, complete, and current contact, personal, and medical information. NGTC is not responsible for issues arising from incorrect or outdated information.

Medical & Health Disclosure

You must disclose all injuries, medical conditions, behavioural conditions, or health concerns that may affect participation. NGTC reserves the right to request medical clearance or refuse participation without refund where safety is a concern.

4. Booking & Payment

Booking Methods

Bookings may be made via:

In person
Phone / WhatsApp

A booking is not confirmed until payment is received or a valid payment method is authorised.

Payment Terms

Memberships are charged monthly in advance and renew automatically
Term-based programmes and private sessions must be paid in advance
Attendance without payment constitutes agreement to pay all applicable fees

Payment Methods

We accept payment via:

Direct Debit
Debit/Credit Card (e.g. Stripe)
Bank transfer
Cash (only where expressly agreed)

Joining Fee

A one-time joining fee applies to all new memberships:

The first 20 members will pay a joining fee of £60
After the first 20 members, the joining fee will be £80

The joining fee is payable in addition to membership fees and is non-refundable.

Failed Payments & Continuous Collection

If a payment fails for any reason (including insufficient funds, expired card, or bank rejection), NGTC reserves the right to:

Automatically retry payment continuously and repeatedly
Suspend access to classes until payment is received
Terminate membership for persistent non-payment
Recover outstanding balances through legal or collection means

All outstanding fees remain payable regardless of suspension or termination.

Membership Price Changes

NGTC reserves the right to change membership prices at any time. Subscribers will be given 30 days' notice of any price changes before they take effect.

5. Third-Party Membership Purchase Acknowledgement

This section applies to clubs, instructors, administrators, or any other third parties purchasing or renewing memberships on behalf of another individual.

By completing a membership purchase or renewal on behalf of another individual (the "Member"), you confirm and acknowledge that:

I am purchasing or renewing this membership on behalf of another individual (the "Member"), and that I am duly authorised to do so. I represent and warrant that I have obtained the consent of each Member (or, where the Member is a minor, the consent of their parent or legal guardian) to provide their details, to make this purchase, and to agree to these terms and conditions on their behalf.
I understand that by completing this transaction, I am acting as an authorised representative of each Member and that all rights, obligations, and responsibilities arising under this membership shall apply to the Member as if they had entered into the agreement personally.
I confirm that I have provided each Member (or their parent/legal guardian, if applicable) with access to all relevant documents, including the terms and conditions, policies, and waivers, and that they have reviewed and accepted them.
I acknowledge that it is my responsibility to ensure the accuracy of all Member information provided and to promptly communicate any updates or consent changes to New Generation Taekwondo Club.
Where multiple memberships are being purchased, I confirm that I have the necessary authority and consent for each individual Member included in this transaction, and that I will provide proof of such authority or consent upon reasonable request by New Generation Taekwondo Club.

6. Refunds, Missed Sessions & Make-Up Sessions

Strict No Refund Policy

All payments made to NGTC are strictly non-refundable, including but not limited to:

Membership fees
Term payments
Private sessions
Missed sessions
Illness, injury, holidays, or personal circumstances

This applies whether or not the participant attends.

Missed Sessions

Missed sessions are forfeited. No refunds, credits, or extensions apply.

Make-Up Sessions

Where NGTC cancels a session, we may offer a make-up session at our discretion. Make-up sessions:

Are subject to availability
Are not guaranteed
Carry no monetary value
Cannot be exchanged for refunds, credits, or cash

7. Trial Sessions

Nature of Trial Sessions

Trial sessions are offered solely as an introductory experience and do not guarantee:

Continued enrolment
Priority placement
Specific instructors, venues, or class structures

NGTC may withdraw or refuse trial sessions at its discretion.

Limits & Booking

One (1) trial per participant only
Trials must be booked in advance and are subject to availability

No-Shows & Cancellations

Failure to attend a trial session without at least 24 hours' notice may result in:

Refusal of future trial requests
Requirement of full payment for any future attendance

Risk & Liability (Trials)

Trial participants acknowledge that:

Trial sessions involve the same risks as paid sessions
Participation is entirely at their own risk
All liability limitations in these Terms apply fully to trial sessions

8. Membership, Cancellation & Freezes

Membership Renewal

Memberships renew automatically unless cancelled in accordance with the agreed notice period (typically 14 or 30 days).

Cancellation

Must be submitted in writing by email to info@newgentkd.com
Verbal notice is invalid
Fees remain payable during the notice period
Memberships are non-transferable

Membership Freezes

A maximum of two (2) freezes per calendar year
Freeze requests must be submitted by email in advance
Freeze dates must be confirmed in writing by NGTC
Unused freezes do not roll over
No refunds or credits apply during freeze periods

9. Code of Conduct

All students, parents, and visitors must adhere to NGTC rules, including:

Respect for instructors, students, staff, and facilities
Compliance with safety instructions
Appropriate attire and removal of jewellery
Punctuality

Zero Tolerance

Bullying, harassment, discrimination, aggression, or unsafe behaviour will result in immediate removal and possible termination without refund.

10. Safety, Liability & Assumption of Risk

Participation in Taekwondo involves inherent physical risk. By participating, you acknowledge and accept that:

You participate entirely at your own risk
NGTC is not liable for injury or loss except where caused by proven negligence
You are responsible for ensuring fitness to participate

Immediate Removal for Safety

NGTC may remove any participant immediately where safety or behaviour requires it. Parents/guardians will be informed as soon as reasonably practicable. Removal does not entitle the participant to a refund or credit.

11. Parental & Guardian Responsibility

For participants under 18:

The parent/guardian accepts full legal and financial responsibility
Any injuries, safeguarding, or behavioural issues will be communicated using the contact details provided
NGTC is not responsible for failed communication due to incorrect contact details
The parent/guardian agrees to indemnify NGTC against any claims arising from the child's participation

12. Photography & Media Consent

NGTC may take photographs or video recordings during classes and events for:

Coaching and educational purposes
Marketing and promotional use

Consent is automatically granted unless withdrawn in writing by email prior to participation.

13. Intellectual Property

All content, materials, curriculum, logos, images, and website elements are the property of NGTC or its licensors and are protected by UK and international copyright law.

Unauthorised use may result in legal action.

14. Links to Third-Party Sites

NGTC is not responsible for the content, policies, or practices of third-party websites. Use is at your own risk.

15. Termination of Service

NGTC may suspend or terminate services immediately, without notice, for:

Non-payment
Breach of these Terms
Breach of the Code of Conduct
Behaviour deemed harmful to others or NGTC's reputation

Outstanding fees remain payable upon termination.

16. Force Majeure

NGTC is not liable for service disruption due to events beyond our reasonable control, including venue closures, extreme weather, public health emergencies, or government restrictions.

No refunds apply. Sessions may be rescheduled or offered as make-ups at NGTC's discretion.

17. Limitation of Liability

To the fullest extent permitted by law:

NGTC's total liability is limited to fees paid in the preceding three (3) months
NGTC is not liable for indirect or consequential losses

18. Changes to These Terms

NGTC may update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
